For the Petitioner Since the innocuous prayer of the petitioner is for expeditious disposal of Criminal Appeal no. 03/2022 pending before the learned Additional District and Sessions Judge, Fast Track Court, Baruipur, South 24 Parganas, the matter may be considered without service of notice upon the opposite parties. The opposite parties shall not be prejudiced by an order directing expeditious disposal of the case. Learned counsel for the petitioner submits that the petitioner filed an application under Section 12/23 of the Protection of Women from Domestic Violence Act and by an order passed on 7th September, 2022 in Criminal Misc. Case no.
60/22, the learned Judicial Magistrate, First Class, Baruipur, South 24 Parganas directed the first opposite party to pay interim monetary relief to the tune of Rs.15,000/- for the petitioner, Rs.15,000/- for the minor child and Rs.10,000/- for medical expenses of the child, total amount payable being Rs.40,000/-, from the date of the order till the disposal of the case. The said order has been assailed by the petitioner before the learned Additional District and Sessions Judge, Fast Track Court, Baruipur, South 24 Parganas in Criminal Appeal no. 03/22. The petitioner seeks expeditious disposal of the said appeal.
Since the criminal appeal is pending since 2022 and according to the petitioner, not a farthing is being paid by the first opposite party to the petitioner, learned appellate Court is directed to consider and dispose of the appeal pending before him within three months from the next date of hearing fixed before him without granting any unnecessary adjournment to either of the parties, in accordance with law. The revisional application is disposed of.
