By filing this public interest litigation the petitioners contend that the 11th respondent is running a poultry farm in front of the residential house of the petitioners. Several representations were made in this regard. Since no action has been taken the writ petitioners have been filed this public interest litigation.

Since this writ petition is disposed of without calling for affidavits the allegations made in the writ petition are not gone into but we direct the appropriate authority of the West Bengal Pollution Control Board to conduct a surprise inspection in the area in question and if they found that the private respondent no.11 is running a poultry firm in the area in question in violation of the relevant statute and regulations, appropriate action be taken against him in accordance with law. In addition to that, a

report shall also be submitted to the Panchayat authorities if any illegality is found. It is made clear that the inspection shall be a surprise inspection. This direction be complied with within three weeks from the date of receipt of the server copy of this order.
