This writ petition is pending since 1998.

Mr. Roy, appearing on behalf of the petitioner submits that the petitioner has been exonerated in the departmental proceedings over the self-same cause of action on merits.

Mr. Banerjee, learned counsel appearing on behalf of the State fairly submits that pursuant to the order of the Collector, proceedings initiated against the petitioner have been dropped and the goods which had been confiscated have been released. Moreover, the license of the petitioner has also been subssequently regularised.

In view of the submissions of the parties and in view of the exoneration of the petitioner and the subsequent events which have taken place during the pendency of the writ petition, I am of the view that no purpose would be served in keeping the criminal proceedings against the petitioner alive. Accordingly, I quash the impugned proceedings being Siliguri P.S. Case No. 409/98 dated 9th October, 1998 under Section 7(1)(a)(ii) of the Essential Commodities Act, 1955.

With the aforesaid observations, W.P.A 22694 of 1998 is disposed of.

Photostat certified copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
