The petitioner prayed for quashing of proceeding of MP Case No. 793 of 2017 initiated on the application of opposite party no.2 before Learned Executive Magistrate, Canning Sub-Division, South 24-Parganas.

Learned Executive Magistrate, Canning Sub-Division, South 24-Parganas has given direction to the Officer-in-Charge, Canning Police Station to enquire and file report within 15 days and to maintain law and order and peace on the suit land. Since then more than 7 years have been passed. Any order passed under Section 144 of Code of Criminal Procedure would not be effective after six months. Considering the period lapsed since the date of passing order, I find that this matter became infructuous due to efflux of time.

Accordingly, CRR 2619 of 2017, along with CRAN 2 of 2017 (Old No. CRAN 4980 of 2017) are dismissed as infructuous. Interim order, if any stands vacated.

There is no order as to costs.
