Learned advocate on record on behalf of the appellants submits that the matter was settled out side the court. Thus, the appellants are not intending to proceed further with the second appeal. Accordingly, the appellants have handed over a written instruction of the appellants. Both the appellants are personally present before this Court. Let the written instruction of the appellants be kept on record.

Having heard the parties, also considering the written instructions, the instant Second Appeal be, and the same is "dismissed as not pressed".

Decree under appeal is hereby affirmed.

Interim order, if any, passed by this court during the pendency of the instant second appeal be hereby also vacated.

LCR if received be sent down immediately to the learned Court through Special Messenger; cost to be borned by the appellants.

Appellants are directed to submit a Special Messenger cost within a fortnight. On such submission, the department shall engage a Special Messenger, so that the LCR be sent down immediately.

Parties are at leave to receive that the original documents placed in the record by submission of certified copies thereof, according to law.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
