20.08.2024 Sl No.25 Court No.29 TN CRM (A) 2870 of 2024 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure, 1973, corresponding to Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Kandi Police Station Case No.695 of 2023 dated 25.11.2023 under Sections 363/341/306/34 of the Indian Penal Code.

And In the matter of : Rejina Bibi @ Razina Bibi .... petitioner Ms. Minoti Gomes ....for the petitioner Mr. S.S. Imam, Mr. M.F.A. Begg ... for the State

1. The learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated.

2. The learned counsel for the State in opposing the prayer has referred to the statement of the father-in-law of the victim and submits that it directly implicates amongst others the present petitioner.

3. Considering the materials available in the case diary and the nature and extent of complicity of the petitioner in the commission of the alleged offence and there are sufficient incriminating materials against the present petitioner and that the investigation is at the initial stage, we are not inclined to grant anticipatory bail to the petitioner.

4. Accordingly, the application for anticipatory bail is rejected.
