...for the respondent no.1 The appeal was dismissed for non-prosecution by a coordinate Bench on 27th April, 2021. However, this application has been filed for a direction upon the department concerned to send down the lower court records to the learned trial court being the Court of the learned Civil Judge (Senior Division), 2nd Court, Krishnagar, Nadia in connection with the Title Suit No. 46 of 2012 so as to enable the parties to return the original deed. We have been informed that the final decree proceeding is pending before the learned trial court.

In view thereof, we direct the department concerned to send down the LCR to the court concerned within two weeks from date. CAN 4 of 2022 is disposed of. However, there shall be no order as to costs.
