Mr. Sukanta Das ..for the petitioner Mr. Syamal Kumar Da Ms. Smita Pal ..for Barrackpore Municipality It is the grievance of the petitioner that Barrackpore Municipality entered into an agreement for sale with her in the month of June, 2016, in respect of a land measuring about 0.05 decimal which is a part of plot no.1076, Khatian no. 965, J.L. No. 8, Mouza-Mohonpur, District 24 Parganas (North). The agreed consideration for the sale was Rs.7,00,000/- (Rupees Seven Lakh) per cottah. The said land was intended for the construction of a stadium by Barrackpore Municipality.

Learned advocate appearing for the petitioner submits that though Barrackpore Municipality has taken the possession of the land, the sale deed has not yet been executed and the petitioner has only been paid Rs.10,00,000/- till date.

Learned advocate appearing for Barrackpore Municipality submits that to complete the sale, the Municipality requires some time.

He further submits that in the next meeting of the Board of Councillors, the matter will be placed for consideration and the Municipality will adopt necessary resolution to finalise the sale.

In that view of the above, there is no justification to keep this writ petition pending.

Accordingly, this writ petition is disposed of with a direction upon Barrackpore Municipality to take necessary steps to complete the sale within a period of three months from the date of communication of this order, in accordance with law.

Accordingly, WPA 19633 of 2023 is disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
