In view of the report of the Command Hospital dated 26th September, 2023, the petitioner shall be deemed as "medically fit" for the post of Constable (GD) in the recruitment process for the year 2022.

The respondent CRPF has filed instructions that there are no vacancy pertaining to the post of Constable (GD) for the year 2022 as the recruitment process has been completed. The said instruction of the CRPF dated 25th November, 2023 is taken on record.

This Court is of the view that the petitioner cannot be faulted or penalised for the mistake on the part of the Medical Board of the respondents. Since the recruitment process is undertaken every year by the Central Armed Police Forces (in short, CAPFs), the petitioner shall be entitled to be recruited as Constable (GD), subject to

fulfilment of any further conditions as per the recruitment rules.

It is ordered that the recruitment process, so far as the petitioner is concerned, shall be completed within one month from date.

With the above direction, the writ petition, being WPA 19637 of 2023, stands disposed of.

Urgent photostat certified copy of this order, if applied for, be given to the parties, upon compliance of necessary formalities.
