This revisional application is directed against an order dated July 30, 2025 passed by the learned Judge, III-Bench, City Civil Court at Calcutta in Title Suit No. 1615 of 2022 whereby an application under Order I Rule 10 of the Code of civil Procedure, 1908 filed by the opposite party nos. 4 and 5 for addition of party to the suit has been allowed.

The petitioner as well as the opposite party nos. 4 and 5 have jointly taken out an application being CAN 2 of 2026 praying for a consent order disposing of the instant revisional application along with an interlocutory application "by setting aside the order impugned dated July 30, 2025 passed by

the learned Judge, III-Bench, City Civil Court at Calcutta in Title Suit No. 1615 of 2022 (Arup Ratan Gooptu -Vs- Arun Banerjee & Ors.)".

Heard learned Advocates appearing for the respective parties.

Since the order impugned dated July 30, 2025 is one whereby the opposite party nos. 4 and 5 have been added as parties to the suit on their application and it is now apparent from the joint application being CAN 2 of 2026 filed by the petitioner and the said opposite parties that the opposite party nos. 4 and 5 are not interested in joining as parties to the suit (especially paragraph 5 of CAN 2 of 2026), the order dated July 30, 2025 is set aside on consent.

C.O. 3087 of 2025 stands disposed of with the above observations. There shall be no order as to costs.

In view of the disposal of the revisional application, CAN 2 of 2026 is also disposed of.

7. Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
