Mr. Khairul Alam ...... for the petitioner Mr. Prosenjit Mukherjee Ms. Madhurima Sarkar ......... for Madrasah Service Commission The petitioner participated in the 6th State Level Court No. 24 11.02.2022 (Item No. 5) (AB) Selection Test, 2013 conducted by the West Bengal Madrasah Service Commission. He is aggrieved as his name did not feature in the list of selected candidates. Learned advocate representing the Madrasah Service Commission submits, upon instructions, that the name of the petitioner could not be enlisted in the list of the selected candidates because he scored marks less than the last empanelled candidate.

It has been mentioned that the lowest marks obtained by the last empanelled candidate in Arabic Madrasah (M.M.) (H/PG) in Bengali medium - General is 49.75 and the marks obtained by the petitioner is 48.62. As the petitioner scored less marks, accordingly, his name could not be empanelled. The petitioner has made an application before the Madrasah Service Commission praying for supplying the answer scripts of his written examination of sixth SLST, 2013. The same has not been supplied till date. The Madrasah Service Commission is directed to take steps for supplying the answer script to the petitioner under

the Right to Information Act, 2005 at the earliest, but positively within a period of four weeks from the date of communication of a copy of this order.

The writ petition stands disposed of.

The instruction given by the Madrasah Service Commission be retained with the records.

Urgent photostat certified copy of this order, if applied for, be given to the parties after completion of all legal formalities.
