The present revisional application has been preferred challenging the order dated 11.08.2022 passed by learned Judicial Magistrate, 7th Court, Howrah in Misc. Case No. 219 of 2018.
Having regard to the fact that the said order is appelable order, I direct the petitioner to prefer an appeal under Section 29 of the Protection of Women from Domestic Violence Act before the jurisdictional court within a period of thirty days from date.
The learned sessions court would accept the server copy of this order duly downloaded from the official website of this Court while considering any application under Section 5 of the Limitation Act. In case any issue relating to delay crops up, the learned sessions court would take into account the pendency of this revisional application before this Court which was filed within time.
The petitioner is granted liberty to take back the certified copy from the department after the same being replaced by photostat copy.
With the aforesaid observations, the revisional application being CRR 3278 of 2022 is disposed of. Pending connected application, if any, is consequently disposed of.
All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
