Complaints have been filed by the petitioner and the private respondents against each other. FIRs have been registered and charge sheets being Tapan Police Station C.S. No. 415/22 dated 27.07.2022 and Tapan PS C.S. No. 452/2022 dated 31.08.2022 have been filed.

It is also submitted that a civil suit is pending between the private respondents and the petitioner. The Tapan Police Station shall ensure that there is absolutely no breach of peace in the area and strict vigil shall be maintained thereat.

There is already one civil suit pending for partition filed by the petitioner.

It is submitted that the subject property is not the part of the civil suit.

The petitioner may take out civil proceedings in support of their civil grievances against one another. The private respondents and the petitioner undertake before this Court to maintain absolute peace and not to resort to any violence.

With the aforesaid observations, the instant writ petition shall stand disposed of.

There shall be no order as to costs.
