The petitioners are employed in the Madhyamgram Municipality. They seek similar relief as granted by this Court in WP 7402 (W) of (Nishith & Ors.
Vs.
Madhyamgram Municipality & Ors.).
The petitioners, through their learned advocate, filed a representation before the Municipality in July, 2022 and pray for a direction upon the Municipality for consideration of the said representation.
Learned advocate representing the Municipality submits, upon instruction that, presently there is no sanctioned vacancy in the said municipality.
Be that as it may, as it appears that the representation filed on behalf of the petitioners is pending consideration at the end of the municipality, accordingly, the present writ petition is disposed of by directing the Chairman of the Madhyamgram Municipality being the respondent no. 2 herein, to take a decision upon consideration of the representation dated 19th July, 2022 received in the office of the Municipality on 20th July, 2022, strictly in accordance with law.
Reasoned order shall be passed by the Chairman at the earliest, but positively within 28th February, 2023.
The reasoned order shall be communicated to the petitioners immediately thereafter.
It is made clear that this Court has not gone into the merits of the claim of the petitioners and all points are left open to be decided by the aforesaid respondent at the time of consideration of the representation filed on their behalf.
Writ petition stands disposed of.
Urgent certified photo copy of this order, if applied for, be given to learned advocates for the parties upon compliance of all requisite formalities.
