Petitioner informed the Officer-in-Charge, Patuli Police Station on 08.08.2025 and is aggrieved that his flat has been affixed with a padlock at the main entrance. The grievance of the petitioner, additionally, is that in spite of repeatedly informing the police authorities, no steps have been taken. As such, petitioner cannot enter his flat. State has submitted a report which reflects that the information which was furnished by the petitioner has been recorded by way of Patuli P.S. GDE No. 2234 dated 25.08.2025. Police authorities have conducted an enquiry and on enquiry, they found that dispute arose between the present petitioner and one Goutam Guha in respect of selling of the subject flat. To that effect, a case being CC No. 142 of 2013 has been preferred before

the State Consumer Dispute Redressal Commission, W.B. At the time of enquiry, police authorities found no padlock at the main entrance of the flat for which complaint has been lodged. Be that as it may, in view of the enquiry which has been conducted, if the petitioner is aggrieved, he will approach the jurisdictional Magistrate under the relevant provisions of law. Learned Magistrate would assess and ascertain regarding the correctness of the allegations and thereafter pass necessary directions as he deems fit and proper.

With the aforesaid observations, the writ petition being WPA 19720 of 2025 is disposed of. There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
