Mr. Dip Jyoti Ckakraborty ..for the petitioner Mr. Raja Saha Mr. S.P.Lahiri ..for the State The petitioner alleges that the Sub Divisional Officer, Malda Sadar was not disposing of the application filed under Section 11(1)(d) of the West Bengal Panchayat Act, 1973. Without going into the merits of the allegation in the said application, the writ petition is disposed of by directing the prescribed authority (SDO) to dispose of the application filed by the petitioner, in case the same has not been disposed of during the pendency of the writ petition. The authority will dispose of the said application upon affording an opportunity of hearing to the petitioner and all interested parties, including the members whose removal have been prayed for. A competent authority of the Gram Panchayat and also the concerned Block Development Officer may be heard, if necessary. Parties shall be allowed to file their written statements and adduce evidence, if necessary before the SDO.
A reasoned order shall be passed and communicated to all.
The entire exercise shall be completed within a period of four months from the date of communication of this order. Accordingly, the writ petition is disposed of. However, there will be no order as to costs.
All the parties are directed to act on the basis of the learned advocates' communication.
