Heard learned counsels for the parties.

The petitioner is in custody for more than 3 years and prays for bail.

Learned counsel for the State opposes the prayer. The petitioner is the husband of the victim who met with an unnatural death in her matrimonial home. Witnesses including the minor son of the couple have implicated the petitioner in the alleged offence. The petitioner and the victim were residing together at the time of the alleged incident. The petitioner owes an explanation with regard to the circumstances which led to the incident, under Section 106 of the Indian Evidence Act. Offence, if proved, shall attract mandatory life imprisonment.

Considering the gravity of the offence and prima facie involvement of the petitioner therein, prayer for bail is rejected at this stage.

The application for bail is thus disposed of.
