Affidavit-of-service filed by the petitioner be kept with the record.

Petitioner complains that he has been duped of Rs.1.40 crores by the private respondent nos.7 and 8 and in spite of informing the local police station as well as the higher officials of the police authorities, no steps have been taken.

Learned advocate appearing for the State has submitted a report. According to the said report, no documents were submitted, as such, the police authorities could not receive any material in support of any transaction for proceeding with the enquiry. As such, the information so furnished was reduced to Sinthi P.S. GDE no.1787 dated 27.02.2025.

Having considered that the petitioner is aggrieved by the inaction of the police authorities, I

grant liberty to the petitioner to approach the jurisdictional Magistrate under Section 175(3) of the BNSS by producing appropriate materials which are in her custody. Learned Magistrate will assess and ascertain regarding the genuinity of the accusations and thereafter pass necessary directions as he deems fit and proper.

With the aforesaid observations, WPA 19695 of 2025 is disposed of.

There will be no order as to costs.

Report so submitted be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
