Petitioners are directed to serve a copy of the revisional application upon Mr. Mirza Firoz Ahmed Begg, learned advocate who ordinarily appears on behalf of the State. His appointment may be regularized by the concerned Authorities in due course. Mr. Chakraborty, learned advocate for the petitioners submits that the petitioners are in custody since 22nd December, 2021 and after consideration of charges, till date no witness has been examined by the learned trial court.

Having considered the fact that the petitioners are in custody for more than 20 months, I am of the view that the anxiety of the petitioners is justified.

The learned special court, accordingly is directed to fix a schedule of three dates and fix a schedule once in every sixty days so that the trial can be taken to its logical conclusion within a reasonable period of time. No unnecessary adjournemnts would be

granted to either of the parties.

In case any witness who belong to the government department is reluctant to appear before the court on the date so fixed, the learned special court would be at liberty to communicate with the Superintendent of Police of the concerned District so that the appearnce of the witnesses is ensured. The Public Prosecutor conducting the case would produce the materials, documents and exhibits on the dates fixed for examination of the witnesses concerned. All efforts be taken by the stake-holders to cooperate with the trial court so that the trial is concluded at the earliest possible time.

With the aforesaid observations, the present revisional application being CRR 3054 of 2023 is disposed of. Pending applications, if any, are consequently disposed of. All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this court. [Tirthankar Ghosh, J]
