CRR 2618 of 2021 In the matter of:- Sandip Kumar Kundu & Anr. Mr. Avirup Mondal Mrs. Ahana Ghosh Mondal .....for the petitioners This is an application seeking an expeditious disposal of a proceeding under the Protection of Women from Domestic Violence Act.

Learned counsel appearing on behalf of the petitioners submits as follows. The petitioners are the husband and mother-in-law of the opposite party. The opposite party initiated a proceeding under the Protection of Women from Domestic Violence Act as far back as in 2014. She was granted an interim relief and the petitioner no. 1 is regularly paying the said sums in favour of the opposite party and the minor child. During the proceeding on several occasions the opposite party prayed for adjournments. The proceeding has remained pending for no fault of the present petitioners. I have heard the submissions of the learned counsels appearing on behalf of the petitioners and have perused the revision petition.

No prejudice will be caused to anyone if a direction

is passed to expedite the proceeding.

It appears that the proceeding under the Protection of Women from Domestic Violence Act has remained pending since 2014.

An inordinate delay has been occasioned in concluding the proceeding, especially considering the claim of the petitioner no. 1 that he is regularly paying the interim relief.

In view of the above and in the interest of justice, I request the learned trial court to conclude the proceeding as expeditiously as possible without granting any unnecessary adjournment to any of the parties, keeping in mind the true spirit of the statutory stipulations under the Act for an early disposal of such proceedings. With these observations, the revisional application is disposed of Urgent photostat certified copy of this order may be supplied to the parties expeditiously, if applied for. (Jay Sengupta, J.)
