The petitioner is aggrieved by the fact that inspite of directions being passed in TS 229 of 2023, wherein, the learned Civil Judge (Jr. Divn), Kakdwip, South 24 Parganas was pleased to pass directions for maintaining status quo in respect of right, title, interest, possession, nature and character of the scheduled property, the private respondents have been resisting and/or encroaching the property of the petitioner.

Learned advocate also submits that earlier because of post-poll violence, the petitioner could not enter his residence and because of the interference by a Coordinate Bench of this Hon'ble Court in WPA 16392 of 2024, the petitioner has been able to enter his residence. The petitioner now prays that he may be allowed to cultivate the property.

The records of the writ petition speak that the petitioner already approached the learned civil court as also the Executive Magistrate.

Having considered that the civil court is already in seisin of the issue for breach of the civil court's order, it would be for the petitioner to approach the same civil court. The police authorities would only oversee that there is no violation of any law and order.

With the aforesaid observations, WPA 19732 of 2025 is disposed of.

Pending application(s), if any, is also disposed of.
