Mr. Anil Kumar Chattopadhyay ...for the Petitioner Mr. Sandipan Banerjee Mr. Ankit Sureka Mr. Sovan Majumder ...for the HMC The writ petition is taken up for consideration today when Mr. Anil Kumar Chattopadhyay, learned advocate representing the petitioners has again prayed for accommodation in order to come ready and to serve notice upon the respondent no. 6.
The matter was first taken up by this Court on 5th January, 2023 when no one appeared for the petitioners and accordingly hearing of the writ petition stood adjourned. Subsequently, matter was again taken up on 31st January, 2023 when Mr. Chattopadhyay prayed for time to come prepared for advancing argument on behalf of the petitioners.
Acceding to the prayer made on behalf of the petitioners hearing was adjourned.
Thereafter, matter was again taken up on 7th February, 2023 when it was found by this Court that the learned advocate representing the petitioners is not ready with the matter. On finding that though Howrah Municipal Corporation was represented by the learned advocate but
the private respondent was not represented this Court directed the learned advocate for the petitioners to serve notice upon the private respondent (respondent no. 6). Matter was further adjourned and posted for hearing in the month of February, 2023.
Today, accordingly, matter is again taken up for consideration when Mr. Chattopadhyay has prayed for further time to effect service of notice upon the respondent no. 6.
It has also been submitted by the learned advocate representing the petitioners that he is not ready with the matter so further time is required which would enable him to come better prepared.
Howrah Municipal Corporation is represented by learned advocate.
In view of aforesaid position, it appears that petitioners are not interested.
Accordingly, the writ petition stands dismissed. Interim order, if any, stands vacated.
