Dharam Kumar Chakma And ANR. v. State Of West Bengal
D/L150 27.11.2025 C.R.M. (NDPS) 1049 of 2025 In Re: An application for bail under Section 439 of the Code of Criminal Procedure, 1973; read with Section 483 of the BNSS, 2023 filed in connection with Ranaghat Police Station Case No.230 of 2024 dated 29.03.2024 under Sections 18(b)/ 25/29 of the NDPS Act, 1985; Dharam Kumar Chakma & Anr.
Versus
The State of West Bengal.
Mr. Joy Chakraborty Mr. Souvik Ganguly.
...for the petitioners.
Mr. Joydeep Roy Ms. Afreen Begum.
...for the State.
Bpg.
Learned advocate for the petitioners submits that 9.81 kgs. of opium are the subject matter of the case and the seizures were not from the petitioners but from different persons. It is further submitted that the petitioners are in custody for 1 year 6 months and there is hardly any progress in the trial. On the other hand, learned advocate for the State opposes the prayer for bail and submits that there are money trail and CDR reflecting the association of the present petitioners with the principal accused. It has also been brought to the notice of the Court that in CRM(NDPS) 1051 of 2025 a direction was passed to conclude the trial within 8 months from the next date. The order was passed on 18.09.2025.
Having considered that directions were already passed by a co-ordinate Bench, I am not inclined to release the present petitioners on bail.
Accordingly, the prayer for bail of the petitioners in CRM(NDPS)1049 of 2025 is dismissed.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
