1. The revisional application has been preferred praying for transfer of a Matrimonial Suit being No.779 of 2018 pending before the Learned Additional District Judge, 3rd Court, Howrah and the connected Miscellaneous Execution Case No.04 of 2023 and Misc. Case No.83 of 2019, both pending before the Learned Additional District Judge, 3rd Court, Howrah to the Court of Learned District Judge Barasat, North Parganas.

2. On hearing the Learned Counsels for the parties and on perusal of the materials on record, it appears that the distance between the two Courts from

the residence of the petitioner herein, is equidistant and as such the situation does not called for transfer.

3. It is submitted by the Learned Counsel for the petitioner/wife that the husband is not paying maintenance as directed by the Court.

4. The husband/opposite party is directed to pay maintenance diligently.

5. It is submitted by the Learned Counsel for the opposite party/husband that the Trial Court be directed to proceed in the matrimonial suit, expeditiously.

6. Considering the said facts, revisional application is disposed of with the direction that the Trial Court at Howrah, shall make all endeavour to dispose of the matrimonial suit expeditiously preferably within a period of one year from the date of this order.

7. The Writ application stands disposed of.

8. Applications, if any, connected thereto stand disposed of consequently.

9. Interim order, if any, stands vacated.

10. Photostat certified copy of this order, if applied for, be given to the parties on

priority basis upon compliance of all formalities.
