28.08.2025 W.P.A. 19723 of 2025 Item No.30 Ct. No.35 dc.

Subodh Kumar Sarkar versus The State of West Bengal & Ors.

Mr. Sabyasachi Chatterjee , Mr. Pintu Karar, Mr. Akashdeep Mukherjee, Mr. Aritra Ghosh ... For the Petitioner.

Ms. Sumita Shaw, Mr. Soumen Chatterjee ... For the State.

Mr. Bikash Goswami, Mr. Osman Gani Mallick, Ms. Sheuly Saha ... For the Respondent No.7.

Affidavit-of-service filed in Court today be kept with the record.

Report submitted by the learned advocate appearing for the State be also kept with the record. A copy of the report be handed over to the learned advocate appearing for the petitioner.

Petitioner approached this Court being aggrieved by the fact that the information which was sent to the Superintendent of Police, Birbhum along with the Officer-in-Charge, Bolpur Police Station was not acted upon.

State has submitted a report which reflects that Bolpur P.S. Case No. 360 of 2025 dated 13.08.2025 has been registered for investigation against the private respondent no.7 herein. Police authorities have issued notices under Section 94 of BNSS. It has also been pointed out that a title suit being T.S. No. 45 of 2021 is pending before the

learned Civil Judge (Junior Division), Bolpur, Birbhum.

Having considered that the police authorities have already taken steps pursuant to the information furnished by the present petitioner, I am of the view that further directions by this Court are unwarranted. If the petitioner feels insecure, petitioner will take out an application before the jurisdictional court under the relevant provisions of Witness Protection Scheme, 2018.

Learned Magistrate will call for a threat perception report and thereafter pass necessary directions.

With the aforesaid observations, the writ petition being WPA 19723 of 2025 is disposed of. There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
