1. This instant criminal revisional application has been filed by the petitioner for quashing of the proceeding pending before the learned Judge, Special Court, Serampore, Hooghly in Chanditala Police Station Case No.307 of 2016 dated 27th June, 2016 under Sections 4/12 of the POCSO Act and Section 376 of the Indian Penal Code.

2. It is submitted by the learned advocate appearing for the petitioner that though certain allegations have been levelled in the written complaint, the medical report suggests that no such incident, as alleged, has been taken place and the petitioner has been falsely implicated in this case and accordingly, files this revisional application for quashing of the proceeding.

3. However, after going through the materials on record and hearing the learned counsel, it appears that the investigation is still going on and this Court finds serious allegation has been levelled against the petitioner and this Court is unable to accept the submission made by the learned advocate appearing for the petitioner for taking into account the medical report, as alleged and Court finds no reason to admit this instant revisional application when primarily, on the face of the complaint, the allegation are serious.

4. Accordingly, the instant criminal revisional application stands rejected being not admitted.

5. All parties shall act on the server copies of this order duly downloaded from the official website of this Court.
