Abhijit Poddar v. State Of West Bengal
18/09/2025 D/L - 54 Court No.28 S. Kundu Allowed C.R.M.(A) 3019 of 2025 In Re: An application for anticipatory bail under Section 482 of the BNSS, 2023. In connection with Taherpur police station case no. 307 of 2025 dated 20.7.2025 under Sections 318(4)/351(3)/3(5) of the BNS. In the matter of: Abhijit Poddar
...Petitioner.
Ms. Trisha Rakshit Ms. Ivan Sarkar ...for the petitioner.
Mr. Debasish Roy Mr. Asif Dewan ...for the State.
1. Learned counsel appearing for the petitioner submits as follows. The petitioner is a broker of cars. It is alleged that the petitioner went to the alleged victim along with the principal accused and others and gave a proposal to purchase a second-hand Scorpio car sold. A loan was to be arranged by them, but instead of Rs.18 lakhs only Rs.9 lakhs was credited to the account of the de-facto complainant. In fact, it was alleged that the car was not handed over. The petitioner is not responsible for any of these.
2. Learned Public Prosecutor opposes the prayer for anticipatory bail and submits that although the car was transferred in paper in the name of the de-facto
complainant, but it was actually not handed over. Two loans of equal amount were obtained from different entities. One was directly credited to the account of the principal accused and the other one to the de-facto complainant. However, no money trail could be established as against the present petitioner. The other co-accused namely, Dipankar Mondal was granted bail.
3. Considering the materials available in the case diary and the fact that no money trail could be established with the petitioner who claims only to be a broker of cars, I do not think that custodial interrogation of the petitioner is required in this case and I am inclined to grant anticipatory bail to the petitioner.
4. In the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to further conditions that the petitioner shall cooperate with the investigation and shall not threaten or intimidate witnesses. The petitioner shall meet the Investigating Officer once a week till submission of report in final form.
5. Accordingly, the application for anticipatory bail is allowed.
6. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities.
