Dismissed that the petitioner is in custody for 409 days and till date the investigation of the case has not been concluded only partial charge-sheet has been submitted before the jurisdictional court and the proceedings are yet to commence before the court. Learned advocate for the State has submitted a report prepared by Cyber Forensic & Digital Evidence Examiners' Laboratory, Government of West Bengal. Learned advocate for the State submits that supplementary charge-sheet is yet to be submitted by the State before the jurisdictional court. Steps be taken immediately to submit the supplementary charge-sheet within 15 days from date.
It has been informed that the next date has been fixed in the month of January, 2026.
Learned trial court would overcome the stage of consideration of charges on the date so fixed and if otherwise there is no impediment proceed with the trial of the case by examining the witness. Let the evidence of the victim be over within a period of 60 days from the date of framing of the charges. Petitioner would be at liberty to approach this Court after the said stage is over. At this stage, CRM(M) 1473 of 2025 is dismissed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
