The learned Counsel for the alleged contemnor has submitted that the instant contempt petition has been filed on the allegation that the order dated 29th January, 2014 passed in WP No.1046 (W) of 2006 was not complied with by the alleged contemnor. Against the said order, an appeal was preferred by the State Government and in the said appeal, the order dated 29th January, 2014 passed in WP No.1046 (W) of 2006 was set aside and the said judgment has been reported in 2023 (1) CHN (Cal) 80 (State of West Bengal Vs. M/s. Carbin Box & Tube), which was decided on September 7, 2022. A Special Leave Petition, being No.9765 of 2023, filed by the writ petitioner, M/s. Carbin Box & Tube, before the Hon'ble Supreme Court was turned down by the order dated 8th May, 2023.

A copy of the said order is furnished by the learned Counsel of the alleged contemnor. Let the same be taken on record.

It appears that the order dated 29th January, 2014 passed in WP No.1046 (W) of 2006 has been set aside and that has been affirmed up to the Hon'ble Supreme Court. That being the situation, the instant contempt application has no merits at all.

Accordingly, WPCRC 382 of 2014 is disposed of. 5.

In view of disposal of WPCRC 382 of 2014, the contempt application, being CPAN 1408 of 2014 is also disposed of.

The Rule issued be discharged.
