In response to the complaint filed by the petitioner, the Howrah Municipal Corporation heard the parties. The petitioner alleges that no final order has yet been passed.
Learned advocate representing the private respondents submits, upon instruction that, the construction in question is a very old one. No new construction has been made.
Learned advocate representing the Corporation submits that unauthorized construction has been detected and notice for self-demolition of the unauthorized construction has been issued.
It appears from the submissions made on behalf of the parties that the Corporation has already taken steps in response to the complaint lodged by the petitioner.
Accordingly, the Corporation is directed to conclude the proceeding to deal with the unauthorized construction in accordance with law at the earliest but positively within a period of twelve weeks from the date of communication of this order.
The Officer-in-Charge of AJC Bose B Garden Police Station is directed to render all necessary assistance to the men and agents of Howrah Municipal Corporation at the time of implementing the order of demolition, if sought for.
Instruction forwarded by the Howrah Municipal Corporation be retained with the records.
The writ petition stands disposed of.
Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
