Mukherjee, PP Mr. Imran Ali Ms. Debjani Sahu ... for the State Mr. Priyankar Gangyly ...for the CRAN (OP no.2) The present revisional application was preferred challenging the continuance of Lake PS Case No.399 dated October 24, 2015 under sections 341/323/448/509/114 IPC wherein the charge-sheet was submitted under sections 341/323/354/448/509 IPC. During pendency of the revisional application, a joint compromise petition being CRAN No.1 of 2023 has been preferred at the instance of both the parties which included the complainant and the accused-petitioner.

Having regard to the nature of the allegations and/or materials appearing in respect of the criminal case, this court directed learned advocate representing the State to submit a report before this court by way of recording a statement of the victim and also a declaration furnished by her. The State, accordingly, furnished its report. The report includes the statement as well as the declaration of Preeta Bhattacharya, the second opposite party in the revision petition and one of the applicants in CRAN. The contents of the same reflect that she does not intend to proceed with the criminal case including the charge-sheet filed in connection with the Lake PS case any more.

Accordingly, all further proceedings of Lake PS Case No.399 dated October 24, 2015 including the charge-sheet as submitted before the learned CJM, Alipore are hereby quashed. With the above observations, CRR No.3063 of 2023 and CRAN No.1 of 2023 stand allowed.

Pending application, if any, is disposed of.

The report filed on behalf of the State be taken on record. Parties are to act on the server copy of this order duly downloaded from the official website of this court. Certified copy of this order, if applied for, shall be made available to the parties.
