The petitioner is a holder of permanent permit bearing no P.St.P WB2023-SC-0089A in route Midnapur to Bankura bearing no. 1519 Via:

Pirakanta, Goaltore, Sarenga, P.More, Simlapal, Taldangra, Gobindanagar and back. The said permit was issued with an approved time table on 30.03.2023 in favour of petitioner by respondent No. 2.

It is submitted that at that relevant point of time the route has been lying under two district/regions (RTA Paschim Medinipur and RTA Bankura) for which the said permit has been countersigned by the respondent No.5. The said permit is valid till 29.03.2028 and the Vehicle No. WB-33E-9597 is presently ply in strength of permit in the route in question.

The petitioner lodged a complaint before the respondent No.2 and 5 RTA, Paschim Medinipur on 20.06.2024 and 24.06.2024 respectively for issuance of a permit in favour of the private respondents in violation to the Section 69 of the Motor Vehicles Act,1988 but the same remains pending for consideration.

The State respondent files an inter- departmental correspondence dated 13.08.2024 and the same is taken on record.

Upon bare perusal of the instruction it appears that the respondent no. 4 has been requested by the respondent no. 7 to issue a fresh permit without altering the route and the time table mentioned in existing permit against vehicle no.

WB33E/9597 since major portion of the route falls within the Region of Bankura.

After careful consideration of the case on the basis of the available records, I direct both the respondent nos. 4 and 7 to consider the representations dated 25.06.2024 and 24.06.2024 in virtual mode to arrive at logical conclusion for issuance of the permit afresh without altering the route and the time table of the existing permit against the vehicle no.

WB33E/9537 having permit bearing no.WB2023-SC-0089A within a period of 4 weeks

and shall pass a reasoned order in accordance with law in presence of petitioner, private respondents and other stake holders if any, and communication such decision within a week thereafter.

The writ petition being WPA 20412 of 2024 is disposed of without taking an exception to the merits of the case.
