1. Affidavit-of-service, filed in Court today, is taken on record.

2. The solitary contention of the petitioner is that, the petitioner as a Corporation employee has retired on December 31, 2019. The petitioner has received the pension as well as Gratuity amount payable to the petitioner upon retirement. The petitioner has no claim in this

regard. The petitioner only claims interest on delayed payment of Gratuity.

3. In view of the above, the respondent no.3 is directed with the assistance of its Accounts Department to calculate the amount of interest payable, if any, in accordance with law on the delayed payment of Gratuity to the petitioner. The interest shall be calculated at the statutory rate as provided under the relevant provisions of the Gratuity Act since the immediately next date of retirement, i.e. January 1, 2020 till the date of actual tendering of the amount to the petitioner. A detailed calculation shall also be provided to the petitioner.

4. The entire exercise shall be carried out and completed including payment to the petitioner by crediting his bank account by the respondent no.3 positively within a period of ten weeks from the date of communication of this order.

5. In the event of default, the interest shall run @9% per annum.

6. Since affidavits are not called for, the allegations made in this writ petition are deemed not to have been admitted by the respondents.

7. With the above observations and directions this writ petition, WPA 19631 of 2025 stands disposed of, without any order as to costs.

8. The parties shall act on the server copy of this order duly downloaded from the official website of this Court.
