The petitioner submits that the plot of land owned and occupied by the petitioner has been utilised by the State respondents and recorded in the name of the Refugee Relief and Rehabilitation Department in record of rights. The land has neither been acquired by the State respondents, nor has any compensation been offered to the petitioner for the same. The petitioner seeks liberty to submit a comprehensive representation before the concerned Authority ventilating his grievances and direction upon the Authority to consider the representation within a stipulated time frame.

It is submitted on behalf of the State respondents and also appears from the letter issued by the District Rehabilitation Office to the Block Land and Land Reforms Officer, Faridpur, Durgapur Block on 8th March, 2017 that no land has been acquired in the district of Burdwan by the Refugee Relief and Rehabilitation Department.

Upon consideration of the submissions made on behalf of the parties, the writ petition is disposed of with liberty to the petitioner to submit a comprehensive representation before the 4th respondent within two weeks from date.

The 4th respondent shall consider and dispose of the representation within two months from the date of receipt thereof after affording reasonable opportunity of hearing to all the interested parties, including the petitioner, in accordance with law.

The decision taken by the Authority shall be communicated to the petitioner within a week thereof. With the above observations and directions, W.P.A. 20806 of 2021 is disposed of.

There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
