Affidavit-of-service filed on behalf of the petitioner is taken on record.

Petitioner was initially appointed as an Assistant Teacher in a Government aided school on 3rd April, 2006 and thereafter took transfer to the post of Assistant Teacher in Maharaja Cossimbazar Polytechnic Institute, Kolkata (hereinafter referred to as 'said school') and joined the said post on 27th August, 2010.

Learned advocate representing the petitioner submits that petitioner completed 18 years of continuous approved service in 2024 but till date 18 years service benefits have not been extended to the petitioner. Petitioner prays for direction upon the concerned respondent authorities for sanction of 18 years service benefits.

It is also contended on behalf of the petitioner that aforesaid school authority is not taking steps for processing the claim of the petitioner by forwarding the papers to the office of the concerned District Inspector of Schools (S.E.).

State respondents are represented by learned advocate who has submitted that if claim is lodged before the District Inspector of Schools (S.E.), Kolkata same will be decided, in accordance with law. 6.

Having considered the respective submissions made on behalf of the parties, leave is granted to the petitioner to make a representation before the District Inspector of Schools (S.E.), Kolkata being respondent no.3 claiming sanction of 18 years service benefits by four (4) weeks from date.

If representation is made within the aforesaid time, respondent no.3 is directed to decide the same in accordance with law by eight (8) weeks thereafter on granting opportunity of hearing to the petitioner and the said school authority or their representatives. Respondent no.3 shall pass a reasoned decision on the claim of the petitioner and same shall be communicated to the parties by fortnight thereafter.

With the above directions writ petition stands disposed of.
