09.06.2021 Sl. No. 03 CHC Mithun Ct.No.19.

CRM/7738/2017 (Via Video Conference) In the matter of:

Pradip Kar ...petitioner Mr. Prasun Kumar Datta, Ld. A.P.P.

Mr. S. Deb Roy ...for the State The petitioner in-person has not appeared in the instant case in spite of the order dated 8th June, 2021. The opposite party nos.2 and 3 are enjoying anticipatory bail passed by the learned Sessions Judge-in-charge, Alipore, South 24 Parganas on 15th June, 2017 in connection with Haridevpur Police Station Case No.174 of 2017 dated 12th April, 2017 under Sections 468/471/120B/420 of the Indian Penal Code. Considering the length of enjoyment of liberty by the opposite party nos. 2 and 3, this Court is of the view that the instant petition does not deserve any merit. Moreover, conduct of the petitioner suggests that he is not inclined to proceed with the instant application.

Accordingly, the application being C.R.M.7738 of 2017 is dismissed.
