1. Report filed on behalf of the State is taken on record.
2. Heard the learned counsels for the petitioner and the State.
3. Perused the case diary.
4. It is the prosecution case that the petitioner collected loan EMIs from different villagers but did not deposit them to the bank. However, it does not appear that other than statements of the alleged victim, there is any piece of paper to show such money was taken by the petitioner.
5. The involvement of the petitioner can finally be decided by learned Courts.
6. However, considering the above and the other materials available in the case diary, I do not think that custodial interrogation of the petitioner is required in this case and I am inclined to grant anticipatory bail to the petitioner.

In the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to further conditions that the petitioner shall cooperate with the investigation and shall not threaten or intimidate witnesses. The petitioner shall respond to all notices issued by the Investigating Officer of the case appropriately.
8. Personal appearance of the Investigating Officer is noted and is dispensed with.
9. Accordingly, the application for anticipatory bail is allowed.

Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities.
