On prayer of the petitioners, liberty is granted to implead the Special Land Acquisition Officer, Berhampore, District Murshidabad as respondent no.7 in the writ petition.
The cause title of the writ petition be amended accordingly.
Affidavit of service filed by the petitioners is taken on record.
Report submitted on behalf of the State respondents is also taken on record.
The petitioners' grievance is that the land belonging to the petitioners have been acquired by the State respondents, but no compensation has been paid to them for the same. The petitioners submitted a representation before the concerned authority on 7th June, 2022 which is yet to be considered. The petitioners pray for a direction upon the authority to consider the representation at the earliest.
It is submitted on behalf of the State respondents that the 7th respondent be directed to consider the representation in accordance with law.
In view of the above, the writ petition is disposed of directing the 7th respondent to consider and dispose of the representation submitted by the petitioners dated 7th June, 2022 within two months from the date of communication of this order after affording reasonable opportunity of hearing to all the interested persons including the petitioners, in accordance with law.
The decision taken by the authority shall be communicated to the petitioners within a week thereof. With such observations and directions, the writ petition being WPA 20110 of 2022 is disposed of. There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petitions are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be furnished to the parties upon compliance of necessary formalities.
