He submits that by the order dated 7th April, 2025 the petitioners were directed to pay a sum of Rs. 1,71,400/- by 2nd May, 2025. He further submits that an application for modification of the said order was taken out praying for allowing the petitioners to pay the said amount by five installments.

However, when this matter is taken up for hearing the learned advocate appearing for the petitioners submits that he is now ready and willing to pay the entire amount and he is carrying the cheque for the said amount with him. He submits that the application for sale of the asset is being fixed for hearing on 2nd September, 2025 before the learned Arbitrator. Considering the fact that the petitioners are ready and willing to pay off the amount of Rs. 1,71,400/- and

C.O. 3107 of 2025 stands disposed of by requesting the learned Judge In Charge, 8th Bench, City Civil Court at Calcutta to prepone the date of hearing of the Misc. Case No. 1279 of 2025 prior to 2nd September, 2025 upon an approach being made by the petitioner in that regard. The learned advocate appearing for the petitioners is directed to forward a copy of this application along with this order to the opposite party as well the learned advocate representing the opposite party before the learned City Civil Court by tomorrow.

There shall be, however, no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
