The present revisional application has been filed for expeditious disposal of Baishnabnagar Police Station Case no. 103 of 1996 dated 17.10.1996 pending in the court of learned Chief Judicial Magistrate, Malda.

Earlier by an order dated 26.09.2022, a report has been called for. Accordingly, Mr. Hossain, learned advocate for the State has submitted a report. Let the same be kept with the record. The report reflects that three of the accused persons have died in the meantime and warrant, proclamation and attachment is pending in respect of the accused.

Having regard to the fact that the case is of the year 1996, i.e., almost 26 years have expired since then, I direct that the learned Chief Judicial Magistrate, Malda will exhaust the process of warrant, proclamation and attachment immediately, segregating the case in respect of the accused persons(S) who are present before the court

and take steps of commitment of the case within a month from date. Once the case records are placed before the learned Sessions Judge, the learned Sessions Judge would take into account, the pendency of the case for the last 26 years and immediately frame the charges within 2nd week of January, 2023 and fix the schedule of the present case consisting of three days on each and every ten days so that the trial of the case can be completed within a reasonable period of time.

With the aforesaid observations, the present revisional application being CRR 2625 of 2021 is disposed of. Pending applications, if any, are consequently disposed of. The learned courts are directed to act on the server copies of the order duly downloaded from the official website of this court. [Tirthankar Ghosh, J]
