The petitioner's application seeking transfer was returned on 20th January, 2022 by the head of the institution with the remark "your application has been sent back to you on decision of MC of Dwarin High School". The petitioner again applied for transfer on 25th January, 2022 but the same is pending consideration before the head of the institution.

Without entering into the merits of the same, the instant writ petition is disposed of by directing the head of the institution to consider the said application and if the prayer of the petitioner is allowed, then take necessary steps to forward the application of the petitioner to the District Inspector of Schools (Secondary Education), Uttar Dinajpur in accordance with law at
the earliest but positively within a period of eight weeks from the date of communication of this order. 3.
The District Inspector of Schools shall take consequential necessary steps in the matter at the earliest but positively within a period of eight weeks from the date of receipt of all documents from the school.

If the application of the petitioner for transfer is allowed, then necessary consequential steps shall be taken without any further delay.
5.
The fate of the petitioner's application shall be made known to the petitioner.
6.
The respondent authority shall act on the basis of the hard copy of the documents forwarded by the petitioner despite suspension of the Utshasree portal.
7.
The writ petition stands disposed of.
8.
All parties are to act on the server copy of this order duly downloaded from the official website of this Court.
9.
Urgent photostat certified copy of this order, if applied for, be given to the parties, upon compliance of necessary formalities.
