Heard learned advocates appearing for the parties.

The petitioner has filed this writ petition being aggrieved by the alleged inaction on the part of the respondent police authorities concerned in considering the petitioner's complaint made before the Superintendent of Police, Malda by a letter dated 19th July, 2023.

Considering the facts and circumstances of this case, this writ petition being WPA 19721 of 2023 is disposed of by directing the respondent police authorities concerned to hold an enquiry on the basis of the aforesaid complaint and take an

appropriate action strictly in accordance with law within a period of two weeks from the date of communication of a copy of this order.

It is clarified that no coercive action against the persons against whom the complaint was lodged shall be taken without giving them an opportunity of hearing. In Course of investigation on the basis of the aforesaid complaint, if the police authorities find that there involves cognizable offence, the authorities concerned are at liberty to treat the said complaint as FIR and to take action strictly in accordance with law against the persons against whom such complaint was made.

Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertakings.
