Sudip Mondal v. State Of West Bengal
C.R.M. (A) 4250 of 2022 05.09.2022 Sl.70 Court No.29 (AD) (Rejected) In Re: - An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Tehatta Police Station Case No.639 of 2022 dated 31/07/2022 under Sections 302/34/120B of the Indian Penal Code. And In the matter of: Sudip Mondal ....petitioner.
Ms. Minoti Gomes ...for the petitioner.
Mr. Madhusudan Sur, Ld. APP Mr. Manoranjan Mahata ...for the State.
Petitioner prays for anticipatory bail.
Learned Advocate appearing for the petitioner submits that there was a free fight. Thereafter, the victim committed suicide. Learned Advocate appearing for the State draws the attention of the Court to the post-mortem report of the victim as well as the statement of the wife of the victim recorded under Section 164 of the Code of Criminal Procedure.
There are injuries on the body of the victim apart from one suggesting death by hanging in the post-mortem report. The statement of the wife of the victim implicates the petitioner. In such circumstances, we are unable to grant anticipatory bail to the petitioner.
Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
C.R.M. (A) 4250 of 2022 is dismissed.
