.....Petitioners Mr. Angshuman Chakraborty ..........for the Petitioners Ms. Puspita Saha ..........for the State The present application under Section 439 of the Code of Criminal Procedure has been preferred by the petitioners in connection with Haroa P.S. Case No. 242/2021 dated 10.06.2021 under Sections 21(C)/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

It appears that contraband substance above commercial quantity was recovered from the joint possession of the petitioners. In view thereof, the statutory restrictions are clearly attracted. As such, we are not inclined to exercise any discretion in favour of the petitioners at this stage.

Mr. Chakraborty, learned advocate appearing for the petitioners submits that after filing of the present application, the chemical report along with the supplementary charge sheet has been filed in the month of January, 2022; but thereafter, there had been no progress.

Ms. Saha, learned advocate enters appearance on behalf of the State.

As the chemical report along with the supplementary charge sheet has been filed, this Court directs the learned Court below

to take up the issue of consideration of charges on the next dated fixed without granting unnecessary adjournment to either of the parties. If charges are framed, the learned Court below shall take appropriate steps towards conclusion of the trial as expeditiously as possible.

With the aforesaid observations, the application for bail, being CRM No. 8764 of 2021, is disposed of.
