Supplementary affidavit filed in Court today on behalf of the petitioner be kept with the record. By an order dated October 1, 2019, a Coordinate Bench of this Court had disposed of MAT 1379 of 2019 by directing, inter alia, that the appellant (private respondent in the writ petition) shall not create any third party interest in respect of the construction in question till such time that the Chairman of the concerned Municipality gives his decision on the complaint of the writ petitioner in terms of the order of the learned Single Judge.

The petitioner says that in wilful violation of such restraint order, the private respondent has created third party interest in respect of the construction in question.

Let a copy of the contempt petition as well as copy of supplementary affidavit be served on the respondent and affidavit of service be filed in Court on the next date.

List the matter once again on December 13, 2021.
