... petitioners Mr. D.Datta ...for the petitioners The present revisional application has been preferred against the order dated 24.11.2003 passed in Case No. C-5016/2003 by the learned Judicial Magistrate, 4th Court, Alipore. The grievance of the petitioners were regarding the rejection of the application under Section 205 of the Code of the Criminal Procedure. The subject-matter of the case relates to alleged offences punishable under Section 506/504/34 of the Indian Penal Code.
In view of the such subject-matter of the case involved and the order so passed by the learned Magistrate, I direct that the learned Magistrate would reconsider the prayer for exemption for
personal appearance in the day to day proceeding, if such an application is filed at the instance of the petitioners. In view of the observations made above, no fruitful purpose would be served by keeping the revisional application pending before this Court.
With the aforesaid observations, C.R.R.2824 of 2003 is disposed of. All the connected applications are accordingly disposed of.
Interim order, if any, is hereby vacated.
All parties shall act in terms of copy of this order downloaded from the official website of this Court.
