Exception used by the petitioner to the report in the form of affidavit submitted by the State is taken on record. It appears that the private respondent has raised the construction in question upon obtaining sanctioned plan from the concerned authority.

In view of the above, nothing further remains to be decided in the writ petition. The same is accordingly disposed of.

However, since the petitioner alleges that the sanctioned plan was granted without conversion of the land in question, the petitioner is at liberty to take appropriate steps for redressal of this grievance. There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted.
