This is an application where petitioner has sought for expeditious disposal of Title Suit No.467 of 2019, pending before the learned Civil Judge (Senior Division), Baruipur, South Parganas.

It is submitted on behalf of the petitioner that the petitioner filed the aforesaid suit for Specific Performance of Contract on 26th September, 2019. Plaintiff has already complied with the directions and thereafter it appeared in the daily cause title for as many as six times, but the hearing of the suit has not yet been commened, in spite of the fact that the suit is pending for a long time..

Since prayer made by the petitioner is innocuous, service of copy of revisional application upon the opposite party is dispensed with.

Having considered the facts and circumstances of the case and that if the present application is

disposed of in terms of the prayer made in the application, neither party will have any cause to prejudice and that prayer made in the application is innocuous and reasonable, the application being C.O. 2249 of 2021 is hereby disposed of with a direction upon the court below to make every endeavour for expeditious disposal of the suit without granting any unnecessary adjournment to either of the parties and to make his best effort to conclude the entire proceeding of the suit, preferably within a period of six months from the date of communication of this order. Urgent photostat certified copy of this order, if applied for, shall be given to the parties on priority basis, upon compliance of necessary formalities. (Ajoy Kumar Mukherjee, J.)
