Ms. Nupur Chaudhuri Mr. Sahil Hamid ... for the petitioner This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Senior Division), 6th Court at Alipore to dispose of Title Suit No. 33 of 2020 expeditiously.

The learned advocate appearing for the petitioner submits that the instant suit was filed sometimes in the year 2012 and was registered as Title Suit No. 77 of 2012 and the same has been subsequently renumbered as Title Suit No. 33 of 2020. She prays for a direction upon the learned trial judge to dispose of the suit expeditiously.

In view of the order sought and proposed to be passed, there is no necessity to issue notice upon the opposite parties.

However, the learned advocate appearing for the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite parties or upon the learned advocates representing the opposite parties before the learned trial judge.

From the ordersheets appended to this application this Court finds that by an order dated 20th March, 2025 the learned trial judge fixed 30th April, 2025 for hearing of the petition for removal of the survey passed commission.

In the light of the submissions made by the learned advocate for the petitioner, the learned trial judge is requested to make an endeavour to dispose of the Title Suit No. 33 of 2020 as expeditiously as possible but preferably within a period of one year from the next date fixed without granting any unnecessary adjournments to either of the parties.

This order has been passed taking note of the fact that the suit is pending from the year 2012.

With the above observations, C.O. 3112 of 2025 stands disposed of.

There shall be, however, no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
