The petitioner is aggrieved by the order dated 10th October, 2014 passed by the District Inspector of Schools (SE) rejecting his prayer for the post-graduate scale of pay.
The petitioner had participated in the RLST 1998 and was selected as an Assistant Teacher in BioScience. The post carried pass-graduate scale of pay. The petitioner had obtained B.Sc (Honours) in Botany earlier in the year 1985 and obtained M.Sc. and B.Ed degree in the year 1988 and 1990 respectively. The District Inspector of Schools found that the petitioner having joined the pass-graduate category post couldn't claim post-graduate scale of pay since the claim is higher than the post. The petitioner knowing fully well that the he is going to receive a pass graduate scale of pay had joined a pass graduate post. The petitioner therefore cannot use a prior post-graduate degree and claim undue
and unfair benefit after having entered into the service in pass graduate category post.
This Court does not find any infirmity in the impugned order. The circular dated 3rd June, 2002 relied upon by the petitioner has no manner of application since it applies to teachers who are already enjoying honours graduate scale of pay.
No relief can be granted to the petitioner. W.P.A. No.18610 of 2015 is therefore dismissed. There shall be no order as to costs.
